Law Applicable to Contractual Obligations from International Industrial Property License Agreements in the Absence of Choice of Law

Abstract

The rules determining the law governing contractual obligations arising from the international licensing agreements are in the European Union set out in the Rome Regulation. The main pillar expressed in Article 3 is the principle of autonomy. Equally important, however, it is Article 4 containing the rules for determining the applicable law in cases where the contract contains no agreement on the choice of law. The present paper focuses specifically on Article 4 Rome I Regulation in relation to international industrial property license agreements in the absence of choice of law.
