Electronic evidence in competition law

Vol.4,No.7(2013)

Abstract
Competition authorities are limited in their use of electronic evidence by a number of factors and competi-tors rights. These limitations are to ensure the protection of legal interests of involved competitors. Such limita-tions include the protection of professional legal privi-lege and the prohibition of fishing expeditions. Some of these limitations were recently a topic decided on by European courts and therefore require new assessment.
