An Attempt at the Network Analysis of Primary Regulations

Abstract

This paper is dedicated to the experimental application of network analysis to the Czech legal order (primary legislation), with the objective of applying to it the system theory of law and the concept of centres and peripheries. A dataset comprising references between laws, derived from e-Sbírka, was transformed into a network model. The paper includes a basic analysis of the degree distribution of nodes and a quantitative and qualitative analysis of isolated and peripheral laws. The quantitative analysis of the length and average amendment rate of each group of laws is interpreted in terms of the decay of legislative activity at the periphery and the obsolescence of peripheral laws. The experiment demonstrates the potential of network analysis for a deeper understanding of the structure of the legal order.
