Fictionalism, Principle of Utility and Application of Law
Vol.31,No.3(2023)
This article deals with fictionalism and its use in response to process of law application. It aims to cover two steps of this process and elucidate their fictitiousness. It points out imperfection of theoretical treatment as a result. Firstly a subsumption sets up fiction of personification and secondly the conclusions of modern epistemology lead to deduction about impossibility of application of law but possibility of application of image of law. Aim of this article is to demonstrate additional approach to application of law and to extend knowledge in a field of law fictions. It also points out use of principle of utility in fictional environment.
