Reflections on Simplified Forms of Criminal Prosecution (Diversion) de Lege Ferenda

Early in 1993 Criminal Order recodification projects were initiated. In the course of the recodification works it was proceeded to the partial amendment of Criminal Order - it was made by Act No. 292/1993 Coll. In view of the fact, that the marked simplification, effective deformalization and acceleration of criminal prosecution were the aim, the recodification board worked at possibilities of dealing with case beyond the framework of main proceeding. At the same time it was proceeded from general deliberations on the purpose and the significance of criminal prosecution. After setting general starting points, in our conditions it is necessary to work at conditional interruption of criminal prosecution, criminal instruction, settlement, plea of guilty and plea bargaining.
