Czech International Private Law Untill the Year of 1948

Abstract
The author of the article deals with the legal arrangement of international private law that preceded the codification of Czech international private law implemented in the Act No. 41/1948 Coll. This arrangement was included, in particular, in the assumed Austrian Civil Code and some other legal regulations. This legal arran­gement was, however, too brief, incomprihensible and vague. These insufliciencies together with efforts aimed at unification of private law in both of the legal spheres of former Czechoslovakia led to attempts at creation of a new and complete legal arrangement of international private law, included in the frame of preparations of new Czechoslovak Civil Code.

The article provides analysis of the legal arrangement of relations with a foreign element concerning general parts of civil law, material rights, abligation law, labour law, law of succession, family law as well as industrial law and copyright. A con­siderable amount of attention is also paied to the legal status of foreigners in civil relations, internation procedural law. International private law valid in Slovakia is dealt with in a special part. The analysis of legal arrangement of international private law valid untill the year of 1948 is amended by provisions of international private law included in the draft of the Czechoslovak Civil Code.
