Some notes to the so called dispositive competence of an employer

Abstract
The typical feature of the labour relation is the fact, that in the range of this relation the employee is under the will of his employer. The will of an employer is limited by several factors: firstly by the wording of a labour contract (a type of work, a working place and other working conditions). The will of an employer is limited by the legal regulations as well, especially the regulations dealing with a working security and with a protection of the health in a working process. The direct leading of an employee is carried out by an employer (by his managers) through so called binding instruction, that can have the nature of a legal act or the nature of a will manifestation, that is not a legal act. The author considers the internal regulations in an organisation to be a special type of an instruction (for example the working order).
