The work contract

Abstract
The Commercial Code regulates the work contract in § 536 - § 565. We classify this contract among so called "relative commercial contracts", i.e. the obligation between businessmen, when in the stage of concluding of a contract is clear, that it deals with their business.

In the case of a work contract we will frequently use the text of § 261 paragraph 2 of the Commercial Code, that the Part III of the Code (in that is the work contract placed) regulates as well the obligations between the state or the self­governing territorial unit and the businessman, if these obligations concern with the providing for public needs (for instance in the case of building and reconstruction of the buildings). For that purpose the Code states that the state organisation as well, if it concludes the contracts, when from the wordig of such a contract follows, that the object of the contract is the fulfilling of public needs.
