Abstract
The apointments § 8 - 12 of the Trade Code regulating trade names are contradictory interpreted. To explain the appointments well we have to take the functions of trade names into consideration. The most important ones are: identification, promotion and guarantee.
We also have to dífferentiate the trade name (used by entrepreneurs by legal acts) from abbreviations of this name (used in advertising, the legal characters of them is described as "special mark").
The protection of trade names and special marks is given by appointments § 8 - 12 of the Trade Code and also by the regulation on unfair competition in § 44 - 55 of the Trade Code. The appointment § 47 regulates the danger of confusion of names. The protection given by the regulation on unfair competition is wider than the protection given by § 8 - 12 of the Trade Code.
