Vybrané problémy zajištění práva na obhajobu v trestním řízení proti mladistvým

Vol.6,No.1(1998)

Abstract
The presentation deals with some aspects of the right to defence in the criminal proceedings against juveniles.

In accordance with the topic of the presentat1on, general characterization of criminal proceedings against juveniles has been provided, with respect to basic differences from criminal proceedings against adults.

Independently the right of juveniles to defence has been analysed, because the Code of Criminal Proceedings states, that in a juvenile's case defence is obligatory (it means, the juvenile must be represented a lawyer).

However, on the other hand there are some juvenile criminal cases, in which the right to defence was infringed. In connection with the infringement of the right to defence three basic questions were discussed here. Their solution is considered a precondition of legality of criminal proceedings against juveniles.

Last, the author demonstrated two particular criminal cases, in which the Supreme Court stated serious infringement of the right to defence.
