The Basic Legal Norm

Vol.16,No.2(2008)

Abstract
Kelsen and Pitamic reason from different starting points. Kelsen supports the thesis of separateness, while Pitamic argues that law and morals are necessarily connected (the connection thesis). The thesis separateness can be acceptable for legal observers, e. g. for researchers. The connection thesis is a necessary starting point for legal participants, e. g. for judges, who decide in concrete cases. The claim that legal decisions must be correct, i. e. richtig, is in accordance with Pitamic’s understanding of the basic legal norm.
