Dissenting Opinions as Future Majority Opinions

Abstract
This article deals with transformation of dissenting opinions into majority opinions. It identifies three types of transformation of dissenting opinions into majority opinions, analyses the main features of each type of transformation, and discusses its advantages and disadvantages for the dissenting judge. Theoretical findings are supplemented by specific examples of transformation of dissent into a majority opinion, which come mainly from the case law of the US Supreme Court.
