Relationship of Fundamental Rights and Civil Law in Select Countries

Abstract
The article deals with the question whether fundamental rights and freedoms may influence civil law cases. There is no practically resolution of this problems in the Czech republic on theoretic level. Author is dealt with regulation of this problems in constitutions and court decisions in Czech republic, Germany, Switzerland, Estonia, Lithuania, Slovenia, Spain, Portugal, Great Britain, United States, Austria, Columbia, Brazil and South Africa. In countries belonging to European legal system is noticeable influence of Germany doctrine with concept of fundamental rights as objective values binding for whole legal order. Fundamental rights must be respected by all organs of public authority in their activity. In USA is necessary being state action for use fundamental rights in civil case.
