The author deals with the historie circumstances of adoption of the Charter of Fundamental Rights and Freedoms before 20 years ago. At the same time he examines legislative issues of its inclusion in the legal order of the Czech Republic. In 1991 and 1992 was in the Czech Republic chosen a special method of the implementation of international standards of human rights. Their regulation is not a component of the particular chapter or part of the Constitution of the Czech Republic 1992, as it is otherwise usual in the world. The regulation is included in a separate lega) document (the so-called "the Charter"), whereon the Constitution only refers to. The author also deals with the peculiarities of this normative and dynamic reference and its consequences for the content of the Charter.
