The New Hungarian Basic Law and the Changes in the Field of Constitutional Review

The Hungarian governmental system has been established by the Act No XX of 1949 on the Constitution essentially revised during the changes in 1989. The former system of constitutional review (Constitutional Council since 1984) was replaced by the new institution of the Constitutional Court. The author deals with its activism and methods of interpretation of the so called “invisible” constitution. The main attention is paid to changes in the enshrinement of the Hungarian Nocstitutional Court after the elections in 2010 – especially to a new method of selection and appointment of its judges, to the restriction of competences in the area of the state budget and financing of the state. At the conclusion the author assesses this issue from the perspective of the new Basic Law of Hungary, which was adopted in April 2011.
