Fixed-term Contract of Agency Workers

Vol.22,No.3(2014)

Abstract
An article points out the widespread negative practice in labor market when concluding employment contracts with a fixed term employees who are seconded to work for the user employer. Inappropriate interpretation of the term “legal event” has been particularly highlighted, which may mean a limited period of employment for a definite period as well as the duration of the temporary assignment, which in result leads to the conclusion about the abuse of law and evading mandatory provisions of the Labour Code. At the same time, currently - prepared amendment of the relevant statutory provisions is presented, which simultaneously should, to some extent, solve the wrong legal conclusions of judicial institutions.
