Legal Changes in the Field of Fompensation of Crime Victims from the State

The new Victim of Crime Act brought several changes comparing to the previous diction in the field of the provision of financial support. This is considered as a positive changes. Financial support is therefor provided to a wider range of victims of crime. In terms of the international obligations the law has settled an extension of periods for applications of financial suport, and also the transit of claim for a compensation of harm from victim of crime to the state (Czech republic) up to the provision of financial performance. Providing instructions for police authorities about the right to financial support, as well as a partial extension of the eligible applicants for compensation, has its for and against in the question of improving the provision of financial support to crime victims. As a result of those legislative changes will be increased amount of the payment of financial support. The Victim of Crime Act also contains more defaults in the field of provision of financial support to crime victims. As an example can be used the examination of the financial circumstances and incomes of the victim, incorrectly chosen terminology of phrases indicating results of crimes or discrimination of victims of property crimes in embrasing of their right to financial support from the state. Despite the lack of regimentation in the right to financial support, the effective Victim of Crime Act represents the distension of fundamental rights of the victim, strengthening of its position in criminal proceedings and the approach to modifications of the Member States of the European Union, which have long term experience in the field of protection victims of crime. Another legislative development in the field of crime victims protection creates space for the consistent elimination of above mentioned defaults.
