Just Child Maintenance Rate in Current Partice within Czech Courts. Time for Objectification?

Vol.23,No.3(2015)

Abstract
This contribution concentrates on an area of family law that became a daily issue for Czech judges - on determining a just child maintenance rate. Although it is not a marginal area of law, and issues are constantly highlighted in this area, regulation has hardly changed with the introduction of the new Czech Civil Code. In reaction to common problems, this contribution discusses possible models for the determination of child maintenance rates, foreign models will be presented and an independent chapter focuses on current practise within Czech courts. Finally, the question of whether it is time for an objectification of child maintenance within the Czech Republic is discussed.
