Roman law and the law faculty in Brno

Vol.1,No.2(1993)

Abstract
The essay is inspired by effort of the faculty in Brno to deepen the lessons of Roman law in tune with needs of contemporary jurisprudence as well as those of law practice, and with ample tradition of this subject, esp. in the period of first republic. It points out some approaches and conceptions which can enrich contents and methodology of the lessons. Scientefecal interpretation of general validity of the Roman law requires an explication of it's rise and development in abroad context, including the function of state and law in securing individual and public life as a medium organizing an order for individual persons as a primary reality and a social unit. The explication of general validity in the whole context enables us to understand that processes, rules and institutions are conditional on time. At the same time it enables us not to forget some autonomy of spiritual worth and it's general validity. The preparatory function of Roman law and it's influence in the area of law cultur are irreplaceable, although it's wideness, contents and forms are discussible. The faculty in Brno follows excellent romanists who were practising here. The most relevant is the work of Jan Vážný. The essay describes development of Roman law lessons at the faculty in the period after the World War II.
