Some Comments on Unfair Advertising

Abstract
The problems of unfair advertising are currently coming into the focus of the interest of both lay and expert public. The importance of competition law will incrase in our country also due to the position this branch gained in the EC law. In this essay I tried to sketch the development of the legal regulation of unfair competition in our territory up to the present, outline the history of advertising and also tried to analyze the Commercial Code substantive law regulation of unfair adevertising. The core of my work rested in analyzing the several factual bases their interrelationships and their relationship with the general clause. To demonstrate the enormous variety of the unfair competition cases, their consideration by both Czechoslovak and foreign courts and in many times tbe ambiguity of qualification I illustrated the theory by court decisions and artificial cases. I also tried to highlight the relationships of the competition law with other related branches of law.
