Comment on the Role of Law in the Process of Economic Transformation

Vol.2,No.1(1994)

Abstract
The reality of many countries confirms that, in a free civil society based upon a fully developed spontaneous (in nuce not created by a man) order, apparently there is no general reason due to which it is not possible to complete, correct, or more exactly cultivate the operating of spontaneous (market) forces purposefully.

However, the problem can be seen from another point of view in a post totalitarian stage of a social development in contemporary the Czech Republic. The fact, that due to the previous long lasting, nearly absolute, programmatic negation of the market, the impairment of the essence itself in the spontaneity of the order cannot be excluded, means, that neither the need for "artificial" reviving measures aimed at starting and accelerating autoregulational mechanism can be excluded.
