General Problerns of the Juridical Protection of Minorities

Abstract
The question of minorities and of their protection is really a complicated and camplex one. It encompasses mainly following aspects: social-psychological, sociological, historical, these of national and international policy as well as those of domestic and international law.

The law-making in the field of minorities protection is hindered by several circumstances: the factual situations of individual minority groups differ substantially, there is no generally accepted legal definition of minority and, finally, there are two deeply different approaches to the juridical protection of minorities - that considerig the rights of minorities as individual human rights of persons belonging to such minorities and that treating them as collective rights.
