The article deals with the substantiation on which the Constitutional Court refused the proposal to repeal the Act on the Illegality of the Communist Regime and the Resistance Against It, the core of the Act being the provision on the unapplicability of limitation in the case of certain crimes not prosecuted by the previous regime for political reasons. Tbe author is opposed to the arguments of the Constitutional Court, maintaining that the ruling concerned is contrary to the Charter of Fundamental Rights and Liberties.
