Cartel Law in the Context of the Economic Transformation

Abstract
The paper evaluates the development of cartel and anti-monopoly legislation in the Czech territory and examines the connexions between this public law part of competition law and the specific economic and political circumstances of certain periods. Special attention is paid to the development following the adoption of the Economic Code in 1964 and the related by law regulation of the planned management of the national economy.

The author also comments on the deformations in the supply/demand relati­onship connected with the social circumstances in the several periods and their reflection in the anti-monopoly legislation (especially the prohibition of the misuse of economic position, contract-making duty).

The paper also includes a brief characteristics of the new Economic Competition Protection Act, commenting especially on its purpose and personal material and territorial competence. It is an outline giving paper forming a logical entity in connection with other analytic positive law essays commenting on the Economic Competition Protection Act.
