The conception of criminal responsibility of juvenile persons

Abstract
The article is concerned with one of the issues of juvenile criminal justice, particularly with the issue of determining the lowest possible age for criminal re­sponsibility de lege lata and de lege ferenda. The ar­ticle concentrates on an analysis of absolute criminal responsibility because it reveals a lot about the current conception of juvenile criminal responsibility. The ar­ticle also attempts at showing that there are some weak points about the criminal responsibility that is constru­cted in this way. The construction of relative crimi­nal responsibility is discussed from various perspecti­ves. From the historie perspective, in relation to law of juvenile criminal justice of 1931 (which is still widely discussed), and in relation to the proposal for new law of juvenile persons' responsibility for illegal action and of juvenile justice.
