The subjective factor in tender

Abstract
The speciality of tenders consists in the influence of opinions (the subjective factor). In general there is no possibility to express opinions in public procurement. On the other hand there are a few orders that ask for credibility (the subjective factor) of a supplier because the credibility is important for a specific performance. Could the subjective factor be legally applied? The article analyzes the contemporary Czech legal regulation and proposes the regulation de lege ferenda. It concerns also discourse about a corruption behaviour.
