Abstrakt
Donation mortis causa is renewed institution in Czech Civil Code, which allows testator to avoid provisions of inheritance law by donation with suspensive condition that the donee survives the donor.
The article brings the interpretation of the provisions of donation mortis causa in the current Czech Civil Code as well as in previous legislations in force in Czech Republic. The interpretation begins with Austrian Civil Code of 1811 and with the Draft of Czechoslovak Civil Code of 1937, which regulated donation mortis causa and were sources of inspiration to current regulation. Later Czechoslovak Civil Codes of 1950 and 1964 conversely strictly banned donation mortis causa until 2014, when current Czech Civil Code came into force. The paper brings interpretation of donation mortis causa provisions in above mentioned legislation and also draws attention to the major problems of this institution in the current legislation.
