The right to paid annual leave in the context of the current case-law of the Court of Justice of the European Union and european legislation

Abstract
The scientific contribution deals with current legal issues of the right to paid annual leave in the context of European legislation and the last adjudications of the European court of justice. The author especially emphasizes the possibility of extinguishment of leave entitlements after expiry of the period prescribed by national laws or regulations and during employee's working incapacity. He aims to clarify to the reader the arguments which formed the basis of legal reasoning of the Court of justice. He also criticises the demonstrable preference the economic dimension of labour law instead of protecting fundamental rights and freedoms of employees.
